These Terms of Service ("Terms") govern your access to and use of the BistroAI platform operated by Liberty IT Technology and Solutions ("BistroAI", "we", "our", or "us"). By using BistroAI, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

BistroAI provides a voice AI ordering platform that allows restaurants to accept food orders via telephone, automatically routes those orders to the restaurant's Square point-of-sale system, and provides order management tools through a web dashboard and tablet terminal.

2. Eligibility

You must be at least 18 years old and authorized to enter into contracts on behalf of the restaurant business to use BistroAI. By using the Service, you represent that you meet these requirements.

3. Account Registration

You must create an account to use BistroAI. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@bistroai.us if you suspect unauthorized access.

4. Square Integration

BistroAI connects to Square via OAuth. By authorizing BistroAI to access your Square account, you grant us permission to:

Read your Square catalog (menu items, prices, modifiers)
Create and manage orders on your behalf at your connected locations
Record payments associated with BistroAI orders
Receive webhook notifications for order and payment events

You may revoke BistroAI's access to your Square account at any time through your Square Developer Dashboard. Revoking access will disable order routing to Square but will not delete your BistroAI account data.

5. Subscriptions and Billing

BistroAI is offered on a subscription basis. Subscription fees are billed monthly in advance. Fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

A 14-day free trial is available for new accounts. No credit card is required during the trial period. The Service will pause at the end of the trial unless a subscription is activated.

6. Acceptable Use

You agree not to:

Use BistroAI for any unlawful purpose or in violation of Square's terms of service
Attempt to reverse-engineer, decompile, or extract source code from the Service
Use the Service to send spam, harass, or harm individuals
Exceed your subscription's usage limits in a manner that degrades service for other users
Share your account credentials with unauthorized third parties

7. Restaurant Operator Responsibilities

You are solely responsible for:

The accuracy of your Square menu (prices, availability, modifiers)
Fulfilling all orders placed via BistroAI
Compliance with food safety regulations, alcohol service laws, and other applicable local laws
Informing your customers that their calls may be answered by an AI agent
Reviewing and confirming orders before preparation when required

8. AI Ordering Accuracy

BistroAI's voice AI may occasionally misunderstand orders due to background noise, accents, or unusual item names. We recommend training your staff to review incoming orders and maintaining clear menu naming in your Square catalog. BistroAI is not liable for losses arising from order inaccuracies caused by AI misinterpretation.

9. Intellectual Property

BistroAI and its original content, features, and functionality are owned by Liberty IT Technology and Solutions and protected by intellectual property laws. Your Square catalog data and business information remain your property. You grant BistroAI a limited license to use your catalog data solely to operate the Service.

10. Limitation of Liability

To the maximum extent permitted by law, BistroAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of or inability to use the Service. Our total liability to you for any claim shall not exceed the fees you paid us in the 3 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that all orders will be processed without issues. Phone carrier availability and Square platform uptime are outside our control.

12. Termination

You may cancel your subscription at any time from the BistroAI dashboard. We may suspend or terminate your account for material breach of these Terms, with notice where practicable. Upon termination, your access to the Service ends and we will retain your data per our Privacy Policy retention schedule.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Disputes shall be resolved in the courts of Dallas County, Texas.

14. Changes to These Terms

We may update these Terms. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance.
